User Agreement

The Williams Bailey Law Firm, L.L.P. (“Williams Bailey”) is providing this website as a courtesy to members of USW 13-227. Williams Bailey may remove this website or substantially alter it at any time without further notice. Membership in USW 13-227 is a requirement to use this site. Users agree to not to circulate information from this website to non-members or to allow access to this website to non-members. Users further agree to take all reasonable measures to ensure the confidentiality of their password, which is needed for access to this site. Williams Bailey does not guarantee the security of the information posted on the website and is not responsible for any damages, including but not limited to actual, incidental, or consequential damages resulting from use of this website.

Content. Users are solely responsible for the content of their postings. Users understand and agree that Williams Bailey does not moderate or screen content prior to posting and therefore does not approve, authorize, censor, edit or otherwise exercise any discretion over the content posted by users and is not responsible for the material posted or any damage it may cause. Users understand and agree to take full responsibility for content they post to the website and retain all ownership rights to content published on this site. All design elements of this site are copyrighted by Williams Bailey.

When submitting content to this site, the following are inappropriate:

• Illegal activity under the laws of Texas and the United States
• Posting material containing profanity, vulgarity, hate speech or threats of violence
• Including any pornographic content (This includes any sexually explicit pictures.)
• Harassing another member
• Providing any content that contains viruses, Trojan horses, worms, time bombs, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information
• Violating the intellectual property rights of a third party
• Defaming a third party
• Including contact or personal information about another individual without their permission.

Williams Bailey reserves the right to remove content posted in violation of these rules and to remove any member who posts such content.

Termination. You can cancel your membership in this website at any time by contacting the Williams Bailey webmaster (presently at hcatherall@williamsbailey.com, but subject to change without notice). Williams Bailey may cancel your membership at this site, or otherwise refuse service to you, at any time for any reason, including violation of this Agreement.

Indemnity. By choosing to use this site, you agree to indemnify Williams Bailey, its officers, agents, partners, and employees from any and all claims or damage, including reasonable attorney’s fees, made by third parties due to, or arising out of content you choose to submit, post or transmit through this site; your violation of this Agreement, or, your violation of any rights of another.

Governing Law. This Agreement is government by the laws of the State of Texas.

Integration. This Agreement constitutes the entire agreement and supersedes any other agreements or understandings (oral or written) with respect to their subject terms. Williams Bailey can amend this Agreement either by e-mailing you about the amended terms, which take effect when we send you the e-mail, or by displaying the amended terms to you when you log in to the site, which take effect when we post them. Otherwise, this Agreement may be amended only by a writing physically signed by the User and an authorized agent of Williams Bailey.

General Provisions. This website and its services are provided “as is.” Williams Bailey does not promise or warrant that any aspect of the site or system will work properly or will be continuously available. Any unenforceable portion of this Agreement shall be enforced to the maximum extent possible and the remaining portions shall be given full effect. Williams Bailey’s failure to act in a particular circumstance does not waive our right to act with respect to that or other circumstances. Williams Bailey shall be excused for any problem due to a factor beyond our control. Williams Bailey’s suppliers are third-party beneficiaries of this Agreement.
